Lowenstein's Bruce S. Nathan and Andrew Behlmann will discuss the importance of a properly completed and executed credit application that also includes well-drafted terms and conditions. The session will also cover the utility of the credit application and terms and conditions to a creditor’s decision to extend credit, collect its claim against a delinquent customer, and fully realize upon risk mitigation tools, such as letters of credit, guaranties, purchase money security interests/consignments, and credit insurance used by savvy credit departments to support an increased credit line or increase recoveries from financially distressed customers. Finally, we will review some of the significant terms and conditions and the benefits that well drafted terms and conditions provide to creditors to facilitate collecting their claims against a delinquent customer and minimizing the risk of a creditor’s liability to the customer.
