Panel: Insights from Experience: A Practical Guide to and Strategies for Protecting Trade Creditors in Subchapter V Cases
As the Subchapter V "small business" provisions of the Bankruptcy Code mark their fifth anniversary, their impact on trade claims has revealed both opportunities and challenges. While these provisions have streamlined reorganization processes and reduced costs for small business debtors, they've significantly shifted the traditional balance between debtors and trade creditors.
Trade creditors have faced several key challenges under Subchapter V, including:
- The elimination of creditors' committees
- A more limited role for Subchapter V trustees
- Relaxed plan confirmation requirements, particularly the removal of the absolute priority rule
- Stretched out payment terms for administrative claims under reorganization plans
