The Subchapter V small business provisions of the Bankruptcy Code, which Congress enacted to expedite and reduce the cost of Chapter 11 cases for small businesses, have been in effect for nearly four years. The American Bankruptcy Institute has established a Task Force to study Subchapter V small business bankruptcy cases and has requested input from NACM on trade creditors' experiences with Subchapter V debtors and suggested changes to Subchapter V small business provisions.
