FinTech Industry: What to do when a Regulator / Law Enforcement Comes a Knocking

This discussion, featuring Lowenstein partner Rachel Maimin, will focus on best practices for responding to government subpoenas, search warrants, and informal inquiries, including when an internal investigation may be necessary. The new FTC chairperson has already indicated it will be a “very active year” in enforcement, and thus far, that promise is coming true. Getting a civil investigative demand or other regulatory subpoena or investigation notice, whether from the FTC or another regulator, can be overwhelming and burdensome, sometimes requiring the production of thousands of documents, depositions, and written advocacy, not to mention potential PR crises if the agency initiates enforcement and follow on consumer litigation. We will talk about the “where to start” as well as how in-house counsel, outside counsel, and other advisors (like PR teams) can team up to tackle the challenges.
