This session will cover the scope and limits of a government investigation of a data breach. After completing this session, participants will be able to:

  • Identify what conduct might give rise to a data breach investigation
  • Distinguish the conduct that is of concern to an agency
  • Understand what the scope of an investigation might be
  • Recognize what the agency might demand and what the agency might do with what is produced
  • Address “new” technologies such as artificial intelligence, generative AI, and messaging apps
