Last June, the New Jersey Supreme Court held in Little v. Kia Motors America, Inc. that, before admitting aggregate proof of damages in a class action, a court must undertake a careful inquiry to ensure that the defendant has a meaningful opportunity to contest the plaintiff’s claims of injury. On this panel, the plaintiffs’ and defendants’ attorneys will be joined by other class action experts, including Lowenstein’s Joseph A. Fischetti, to discuss the Court’s decision in Little and how it will affect New Jersey class action jurisprudence.
