Panelists will discuss the most significant recent gift and estate tax developments involving business interests, including important cases, legislative developments, and regulatory guidance. The session will cover important recent cases, including in the areas of QTIP Trusts and Section 2519 (Anenberg) and taxability of undistributed operating income of foreign corporations (Moore). The panelists also will address the new generation-skipping transfer tax regulations and proposed regulations issued on basis shifting, foreign trusts and donor-advised funds, the many uses of purpose trusts, exemption planning and considerations before the potential sunset of current exemption levels, and the possible impact of the 2024 elections on planning.

Panel: Trust Modification: Planning in Light of CCA 20235018
