In this program, Lowenstein partners Andrew Behlmann and Bruce S. Nathan will provide a primer on the key topics and issues a creditor may face when its financially distressed customer files a Chapter 11 case. The speakers will provide an overview of the bankruptcy chapters, issues underlying involuntary bankruptcy petitions, the impact of the automatic stay that arises in bankruptcy cases, certain “first day” motions (including financing and critical vendor), claims matters, the treatment of executory contracts, 363 sales, the plan confirmation process, and preference claims and defenses.
