Panel Title: Insurance Industry Battles in Bankruptcy

Lowenstein partners Jeffrey D. Prol and Brent Weisenberg will discuss the myriad ways insurers to bankrupt non-profit religious entities have stymied resolution of cases so that they can delay having to pay their contractual obligations on behalf of the insured. By doing so, insurers have deprived survivors of sexual abuse of compensation and closure. Prol and Weisenberg will then present novel ways through which survivors can end the insurers “payment holiday.”

Panel Title: Holding Wrongdoers Accountable in Bankruptcy

The bankruptcy system is designed to restructure financially distressed companies so that they may begin anew with a “fresh start.” But when the debtor is a nonprofit religious institution which allowed children to be sexually abused in its care, the Bankruptcy Code, and the system, fall short in several critical respects. That is especially true when survivors and the public want the debtor to finally face up to its damaging history in a meaningful and impactful way. This seminar will discuss problems with the Bankruptcy Code and both small- and large-scale changes that might help survivors and their attorneys navigate a system which is an ill-fit for accountability.
