Sydney Kaplan’s practice focuses on antitrust and competition matters, including regulatory clearance of mergers and acquisitions, government investigations, internal investigations, and complex litigation.

Working with clients across a wide range of industries, including healthcare, energy, financial services, consumer products, software-as-a-service, online gaming, and other technology-based sectors, Sydney advises on sophisticated corporate transactions, with an emphasis on antitrust regulatory compliance and risk mitigation on such issues as information sharing, price fixing, exclusive dealing, and monopolization. She counsels clients on the Federal Trade Commission’s and U.S. Department of Justice’s pre-merger review process and related investigations, in addition to analyzing and preparing Hart-Scott-Rodino Antitrust Improvements Act (HSR Act) filings.

Sydney also represents clients at all stages of complex civil and criminal litigation matters in in state and federal courts, mediations, and arbitrations. She has defended clients facing regulatory enforcement actions by government agencies and in high-stakes antitrust class action cases.

Committed to pro bono work, Sydney works closely with the New York Civil Liberties Union and the Lowenstein Center for the Public Interest on matters pertaining to reproductive freedom. She was a member of the team that mounted a successful constitutional challenge to the Pentagon’s former transgender service policy, which discharged or denied enlistment to anyone refusing to serve in the gender to which they were assigned at birth or undergoing gender-confirmation procedures.
