Jeff brings to private practice a seasoned perspective from nearly twenty years of service as a lawyer in the military and federal government, most recently with the U.S. Army Intelligence and Security Command (INSCOM). There he served as the principal legal advisor and legal supervisor for all U.S. Army counterintelligence investigations, operations, and collection efforts conducted throughout the United States, with a special focus on cybersecurity.
Jeff’s unique and significant experience with national security matters provides Lowenstein clients with numerous opportunities to work with federal and state government entities to help generate business. Jeff’s intimate knowledge of the U.S. government, particularly the Department of Defense and the U.S. Intelligence Community, offers unprecedented opportunities to our technology clients. Among other things, he can offer legal advice and proposal drafting support to help clients obtain contracts with government customers and internal government programs that are looking for innovative solutions that utilize emerging technology.
His experience includes advising the U.S. Army develop legally sufficient measures to protect computer networks belonging to members of the Defense Industrial Base; creating comprehensive training materials on all aspects of intelligence collection, including the legal authorities and regulations governing intelligence collection in cyberspace; and partnering with components of the U.S. Intelligence Community to facilitate cooperation and collaborative opportunities with SIGINT, HUMINT, and law enforcement agencies and organizations.
Jeff’s previous roles include supervisory attorney for the Defense Intelligence Agency's Science and Technology Directorate; attorney-advisor at the U. S. Department of Justice’s National Security Division, where he represented the United States before the Foreign Intelligence Surveillance Court and filed applications for court orders in counterterrorism cases pursuant to the Foreign Intelligence Surveillance Act (FISA); legal advisor for intelligence activities and operations for components within U.S. Army INSCOM; legal advisor for the U.S. Department of Homeland Security, where he served with U.S. Immigration and Customs Enforcement's National Security Law Division supporting multi-agency efforts to investigate, prosecute, and remove foreign nationals who posed a national security threat to the United States; and prosecutor for U.S. Immigration and Customs Enforcement.
As a member of the Office of Military Commissions’ High-Value Detainee Prosecution Task Force, Jeff assisted in prosecuting the case against Ahmed Khalfan Ghailani and the cases of three other individuals detained by the Department of Defense in Guantanamo Bay, Cuba.
While deployed to Bagram Air Base in Afghanistan, Jeff conducted detainee interrogation operations with the U.S. Army.
