The landscape of ESG rules continues to rapidly evolve on both sides of the Atlantic with implications for American companies, even in the anticipated absence of U.S. federal requirements for the near future. With directives such as the Corporate Sustainability Reporting Directive (CSRD) and others, the European Union (EU) has taken the lead on requiring ESG disclosures and actions from companies, including some based in the U.S. But the EU is not alone; in the U.S., individual states are moving ahead with their own requirements, such as California’s landmark climate disclosure laws (and similar bills pending elsewhere), several states’ extended producer responsibility (EPR) laws, and “anti”-ESG” initiatives in other states. This has left American multinational companies (or those with multinational supply chains or customers) with the challenge of navigating an increasingly complex, divergent patchwork of obligations across multiple jurisdictions, as well as gathering and verifying data necessary to satisfy those obligations. This session during the American Bar Association Section of Environment, Energy, and Resources' 33rd Fall Conference, will explore legal and practical components of this challenge and strategies for addressing them.
