Ever since New Jersey Governor Murphy signed the Environmental Justice Law in 2020, environmental professionals have been told that environmental justice would not creep into site remediation, and that permits needed for remediation would not require an environmental justice review. In effect, site remediation [and thereby Licensed Site Remediation Professionals (LSRPs)] would be insulated. However, what is being done in practice? The environmental justice regulations themselves contain many potential areas for confusion as well as expansion for environmental professionals and businesses in a variety of disciplines.

In this 60-minute presentation, featuring Lowenstein's Mark S. Heinzelmann, a comprehensive overview of the final environmental justice regulations, other environmental justice policies and guidance, and their potential scope and impact will be provided. In addition, the various pitfalls will be discussed, and an LSRP’s view on the ways in which the regulations (and environmental justice in general) may impact site remediation will be explored.
