Lowenstein Retained as Creditors’ Counsel in Two Chapter 11 Cases

Lowenstein Sandler was recently retained as creditors’ committee counsel in the Chapter 11 bankruptcy case of Omtron USA LLC in Wilmington, Delaware. The Siler City, North Carolina-based company listed assets and debt of $10 million to $50 million. Omtron purchased the North Carolina and Pennsylvania assets of family-owned integrated poultry producer Townsends Inc. in a bankruptcy auction in February 2011. Omtron terminated operations late 2011. The Lowenstein team includes Jeffrey D. Prol and Cassandra Porter.
Omtron is the latest in a series of poultry producer bankruptcies in which Lowenstein Sandler has represented the creditors’ committee. The firm is currently serving as creditors’ committee counsel in the Zacky Farms and Allen Family Foods bankruptcy proceedings and previously represented the creditors’ committees in the Townsends, Inc. and Cagles, Inc. Chapter 11 cases.
Lowenstein was also recently retained as creditors’ committee counsel in the Chapter 11 bankruptcy case of Southern Air in Wilmington, Delaware. Southern Air is a U.S. FAA part 121 supplemental cargo carrier and portfolio company of Oak Hill Capital Partners. Southern Air provides a wide range of services including long-term aircraft, crew, maintenance and insurance air cargo solutions, on-demand charters and humanitarian relief flights. As of July 31, 2012, the Debtors’ unaudited and consolidated financial statements reflected assets totaling approximately $206.9 million and liabilities totaling approximately $486.5 million. The Lowenstein team includes Kenneth A. Rosen, Sharon L. Levine and S. Jason Teele.
As of November 1, 2012, the firm was serving as creditors' committee counsel in more than 40 active bankruptcy cases, including Global Aviation, a commercial chartered flights provider for the US military, Chef Solutions Holdings, LLC, a manufacturer of prepared foods; Hussey Copper Corp., a leading U.S. manufacturer of copper products; and Graceway Pharmaceuticals. Also active in debtor representations, Lowenstein currently serves or has served as debtors' counsel to Coach America, one of the nation's largest bus operators; Jobson Medical Information Holdings LLC, a healthcare information and marketing services provider; and RoomStore, a national furniture and bedding retailer.
