Allison Gabala talks to Law360 about New Jersey’s new legislation that will require businesses seeking permits for facilities in “overburdened communities” to submit an environmental justice impact statement. Gabala notes that companies may not have enough data available to determine current conditions and thus predict the effect of the new facilities. "That's one of the greatest challenges and that's something both DEP [the state’s Department of Environmental Protection] and businesses are going to face as they implement these rules and regulations ... how do you find the data you need to truly quantify a business' impact on a community?” she asks.
