Sally J. Mulligan is Counsel to the firm's Litigation Department and a member of the firm's Securities Litigation & Enforcement Practice Group. Ms. Mulligan's practice focuses on federal securities law and general complex commercial litigation.
In the area of commercial litigation, Ms. Mulligan has represented numerous public and private companies in a variety of commercial lawsuits. Ms. Mulligan played a leading role in obtaining a jury verdict in the successful defense of a Massachusetts-based medical research company against claims by a former advisor to the company for breach of contract and unfair trade practices. The former advisor claimed over $650,000 in damages. All claims were denied by the jury following a two-week trial in Massachusetts state court. Ms. Mulligan also played a significant role in defending a $130 million breach of contract case in Virginia state court that resulted in a dismissal of all claims.
Ms. Mulligan’s securities litigation experience has included the representation of public and private companies in a broad range of securities-related lawsuits. Ms. Mulligan played a significant role the successful defense of Emerson Radio Corp. in a federal securities class action lawsuit, where she assisted in obtaining a favorable ruling on a motion to dismiss that resulted in the dismissal of all of plaintiffs’ securities law claims. Ms. Mulligan represents institutional investors in federal securities law actions arising out of the collapses of Belgian technology company Lernout & Hauspie Speech Products, N.V. and Adelphia Communications Company. Ms. Mulligan has also defended institutional investors in Section 16 short-swing profit cases and has handled shareholder rights litigation.
