Kegan A. Brown’s practice focuses on environmental litigation, environmental regulation, product liability, toxic torts, ESG, and transactional due diligence. He represents clients throughout the full lifecycle of complex environmental and products liability litigations and regulatory matters.  He has successfully defended claims in numerous federal and state courts across the country, including the first two natural resource damage actions to ever go to trial in New Jersey (both of which resulted in complete defense verdicts). He also regularly counsels buyers, sellers, lenders, and underwriters on the full spectrum of environmental issues that may affect transactions.   

Kegan has extensive experience addressing litigation and regulatory matters involving natural resource damages, contaminated sediments, and emerging chemicals of concern, particularly per- and polyfluoroalkyl substances (PFAS).  He has been recognized by both Chambers USA and Legal 500 for his expertise in environmental and toxic tort litigation, including PFAS litigation.

  • Representing multiple companies in addressing the investigation and remediation of contamination, both onsite and offsite, including at Superfund sites across the country.
  • Defending a company against a request for a unilateral administrative order to perform remedial work.
  • Advising multiple clients on the litigation and regulatory risks posed by PFAS.
  • The below matters were completed before December 2023, prior to joining Lowenstein Sandler:
    • Represented a chemical company in defending multiple PFAS regulatory and litigation matters, including putative class actions, government enforcement actions (including unilateral orders), personal injury and property damage claims, natural resource damage claims, and medical monitoring claims.

    • Represented a manufacturer in an arbitration trial where the plaintiff sought over $100 million in environmental and contractual damages. Obtained complete defense award, which was affirmed on appeal.

    • Represented a tobacco company in consumer class actions and aggregated smoking and health claims asserted by governmental entities.

    • Represented numerous clients in connection with defending asbestos claims stemming from current or historic business unites or product lines.

    • Represented multiple companies in administrative and litigation proceedings relating to the Lower Passaic River in New Jersey.

    • Represented a property owner in defending against CERCLA and New York statutory and common law claims related to environmental contamination.

    • Represented multiple clients in an environmental indemnity dispute arising from alleged air violations in California.

    • Represented multiple clients in purchasing and selling carbon offset credits to meet climate change requirements.
