Michael B. Himmel comments on a federal appeals court decision affirming the dismissal of a qui tam False Claims Act lawsuit brought against clients Schering-Plough Corporation (now known as Merck & Co., Inc.) and Organon USA Inc. by a former Organon employee. In the lawsuit, the former employee alleged that Organon wrongfully obtained FDA approval for the anesthetic drug Raplon and thereby caused false claims for the use of Raplon to be submitted to Medicare and Medicaid. The U.S. Court of Appeals for the Third Circuit held that the case was properly dismissed for lack of jurisdiction because the plaintiff's allegations were based upon prior public disclosures and he did not qualify as an "original source" within the meaning of the False Claims Act's public disclosure bar.
