Miguel Alexander Pozo is a Member of the firm practicing in the firm’s Litigation Department. He has over ten years of experience representing Fortune 500 corporations, businesses, and non-profit organizations in a broad range of federal and state court litigation matters. His experience has included all phases of fact and expert discovery, motion practice, trials, arbitrations, and mediations. Most recently, Mr. Pozo has counseled clients in matters involving business torts, contract disputes, employment litigation, and consumer fraud class actions.
In 2010, Mr. Pozo was named a "Super Lawyer" by Super Lawyers magazine for his experience in business litigation. In 2009, he was recognized as one of New Jersey's top "40 Under 40" lawyers by the New Jersey Law Journal magazine. Also in 2009, he was named to the NJBiz "Forty Under 40" list honoring men and women who are making headlines in their fields and who exhibit "excellence in business, commitment to community and professional achievement." Both awards recognize an elite group of the State's leading professionals.

Mr. Pozo's business torts experience has included defending corporations in cases involving tortious interference, unfair competition, fraudulent misrepresentation, wrongful termination under the New Jersey Franchise Practices Act, and claims under the New Jersey Consumer Fraud Act. His representative clients have included TAG Heuer, Christian Dior, Hublot, Liz Claiborne, Inc. and Peerless Clothing International, Inc., among others. Mr. Pozo also leads the firm's representation of LVMH Moet Hennessy Louis Vuitton Inc.

His class action experience includes defending large corporations in the pharmaceutical and telecommunications industries. Currently, Mr. Pozo represents a multi-billion dollar pharmaceutical corporation in the defense of several consumer fraud class actions pending in the federal courts. He is also handling a class action asserting claims under ERISA pending in the New Jersey federal court.

He has advised public and private universities and non-profit corporations concerning compliance with federal, state, and local legislation and regulations. Mr. Pozo's experience counseling institutions of higher education includes providing advice relating to academic and disciplinary decisions, contract disputes, internal investigations, joint ventures, and employment matters. In particular, Mr. Pozo coordinates the firm's representation of The Juilliard School.

In the media and entertainment industry, he has counseled clients on matters involving joint ventures, licensing, restrictive covenants, and employment and other related agreements. His representative clients include a major performing arts center, an internationally known multi-media conglomerate and its subsidiaries, and various cable television stations.
In 2009, he was the only attorney named to Defining Trends Magazine's (DTM) 2009 Latino Trendsetter list, which includes Latin music legend Willie Colon, author/activist/baseball wife Laura Posada, and Bronx Borough President Ruben Diaz, Jr., among others.
On October 29, 2009, Mr. Pozo was sworn in as the 30th president of the Hispanic Bar Association of New Jersey (HBANJ), in a ceremony conducted in Hoboken, New Jersey by the Honorable Julio M. Fuentes, U.S.C.J. of the United States Court of Appeals for the Third Circuit.
In 2007, he was named a "Rising Star" by New Jersey Super Lawyers magazine (business litigation), an award that recognizes the state's top 2.5 percent of lawyers under the age of 40. Additionally, Mr. Pozo was featured in the 2005 issue of New Jersey Law Journal’s "50 Leading Women and Minority Attorneys" in the State of New Jersey. Labeled as a “Rising Star,” he was recognized for his outstanding achievements.
Mr. Pozo is also Editor-in-Chief of DiversityisNatural.com, a Web site and initiative of Lowenstein Sandler dedicated to fostering the advancement of women and minorities in the legal profession.
Clerkships
Prior to joining the firm, Mr. Pozo served as a law clerk to the Honorable Lawrence M. Lawson, A.J.S.C., Superior Court of New Jersey, Law Division, Monmouth County. While in law school, he was an intern to the Honorable Harold A. Ackerman, U.S.D.J., United States District Court, District of New Jersey.

Lowenstein Sandler's representation of Schering-Plough (now Merck) in a putative class action seeking damages for the alleged "off-label" marketing of two oncology drugs, Temodar and Intron, is highlighted. The Lowenstein team including Gavin Rooney, Alan Modlinger and Miguel Pozo, won motions to dismiss amended complaints with prejudice, the federal district court for the District of New Jersey finding that the plaintiffs failed to allege injury sufficient to confer Article III standing.,
