Michael J. Caffrey is Counsel to the firm’s Corporate Department and a member of the Investment Management Practice Group. He has extensive experience drafting and negotiating agreements in equity and debt related transactions.
He also advises industrial and manufacturing clients on compliance with federal and state chemical regulations, including requirements under the Toxic Substances Control Act and Right-to-Know laws. He also counsels clients on environmental enforcement issues, including voluntary disclosures under USEPA’s Audit Policy.
Prior to entering law school, Mr. Caffrey was a Research Teaching Specialist at the Environmental Medicine Department, Robert Wood Johnson Medical School, University of Medicine and Dentistry of New Jersey.
Additional experience representing clients in matters involving environmental law include:
- Advising chemical companies on chemical regulatory compliance issues under TSCA, including PMN and NOC requirements, inventory nomenclature corrections, applicability of the R&D exemption, requirements for import certifications, and PCB remediation;
- Defending industrial and commercial businesses in federal and state administrative enforcement proceedings;
- Counseling chemical companies on conducting environmental audits;
- Conducting environmental and regulatory due diligence associated with acquisitions, divestitures and mergers;
- Counseling developers and commercial clients on site remediation;
- Defending industrial clients in CERCLA and state environmental cost recovery litigation; and
- Defending industry in mass-tort and product liability litigation.
Prior to entering law school, Mr. Caffrey was a Research Teaching Specialist at the Environmental Medicine Department, Robert Wood Johnson Medical School, University of Medicine and Dentistry of New Jersey.
