Khizar A. Sheikh is Counsel to Lowenstein Sandler, resident in its Roseland, New Jersey office. Khizar is a business litigator who advises corporate and individual clients in complex litigation disputes in the areas of privacy, fiduciary counseling, and constitutional law and administrative law. He has litigated cases in the state courts of New Jersey and federal courts around the country, on behalf of a diverse client base from Fortune 100 companies, to small- and mid-sized business, to individuals.
Khizar also has an active pro bono and public interest practice in the areas of criminal defense, human rights, and constitutional law.
He has been recognized as a Rising Star by Super Lawyers magazine for four straight years, and selected as a fellow of Leadership New Jersey, a prestigious year-long public policy program for emerging leaders in New Jersey.
Khizar is a former Executive Board member of the Asian Pacific American Lawyers Association of New Jersey and South Asian Bar Association of New Jersey. In 2010, he was co-chair of the National Asian Pacific Bar Association’s successful Northeast Regional Conference. He has also served as President of the Asian Pacific American Law Students Association while he was a in law school.
He currently serves on the Boards of nonprofits Family Intervention Services and Community Health Law Project, which help disadvantaged individuals with family crisis counseling and disability legal services, respectively.
Khizar is active in local and state politics, and serves as municipal chair and on the county committee of a national political party.
Since 2008, he has been an adjunct professor of law at Seton Hall University School of Law in Newark, New Jersey. In addition to teaching, he has published numerous articles and given lectures in the areas of privacy, criminal defense, and litigation against the government.

Privacy/Intellectual Property
- Represent a software consulting company against third-party indemnification claims from a national retailer that was sued in a putative Southern District of Ohio class action for violations of the Fair and Accurate Credit Transactions Act (“FACTA”).
- Represent a financial news organization that was sued for copyright infringement and unfair competition. Temporary restraining order application denied by District Court Judge. Waiting for decision on motion to dismiss.
- Represented a start-up biotechnology company that brought suit in the Eastern District of Pennsylvania against a large non-profit hospital system for trade secret misappropriation. Matter settled on favorable terms during discovery phase.
Fiduciary/Corporate & Trust Governance
- Represented co-trustees of four interrelated trusts who were sued by a co-trustee in the Essex County Chancery Division - Probate Part for claims of breach of fiduciary duty. Matter settled on favorable terms on eve of trial.
- Represented a satellite company and its senior executives in a suit venued in the Southern District of New York against a public telecommunications company that breached purchase and earn-out agreements. Matter settled on favorable terms on eve of trial.
- Represented a beneficiary against executors for breach of fiduciary duty and waste of assets for claims brought in the Essex County Chancery Division - Probate Part. Matter settled on favorable terms on eve of trial.
- Represented three minority partner physicians in the negotiation of new corporate governance and employment agreements.
- Represented a minority shareholder for claims brought in Bergen County Chancery Division for violations of the Oppressed Minority Shareholder Law. Matter settled on favorable terms after discovery and during mediation.
Matters against the Government
- Represent an energy trading company who brought a petition against the United States for the Internal Revenue Service's arbitrary and capricious failure in permitting specific capital gains. Waiting for argument in the Third Circuit Court of Appeals.
- Represent an environmental waste transport and disposal company in complying with civil and criminal subpoenas issued by the Attorney General's office and U.S. Attorney's Office, and then against third-party CERCLA, New Jersey Spill Act, civil conspiracy, negligence, and civil RICO claims. Matter is in the discovery phase in the District of New Jersey.
- Represent an Afghanistan parliamentary official during affirmative asylum proceedings when his identity was leaked through the Wikileaks Internet site, and life threatened by parliamentary members for purportedly being a spy. Waiting to schedule asylum interview with the Department of Homeland Security.
- Represented a specialty chemicals and materials manufacturer in complying with a Securities and Exchange subpoena.
- Assisted in representing a global engineering firm that required a large internal investigation when accused by the Department of Justice of violating the False Claims Act and Foreign Corrupt Practices Act ("FCPA").
- Represented an engineering firm in complying with civil and criminal subpoenas issued by the Attorney General's office and U.S. Attorney's Office, and then against claims of breach of fiduciary duty for alleged bribes made to county officials. Matter settled on favorable terms after discovery and during mediation.
- Represented an Afghanistan citizen during affirmative asylum proceedings who worked as a driver for the New York Times in Afghanistan and whose life was threatened by the Taliban for purportedly being a spy. Asylum granted.
