John J.D. McFerrin-Clancy is a member of the firm’s Litigation Department. He focuses his practice on disputes and risk management in the capital markets. He has represented venture funds, portfolio companies and entrepreneurs in both deal-related and commercial litigation. He has represented financial institutions in CDO and CDS litigation, prime brokerage, senior secured lending and other disputes, particularly among financial institutions; and has both defended and prosecuted a variety of federal securities cases.

Mr. McFerrin-Clancy’s experience includes:
  • Successful defense of foreign financial institution in $2 billion CDO and financial guaranty fraud action brought by New York based monoline insurer.
  • Prosecution of $15 million “earn-out” claim by founder of premiere satellite tracking solutions company.
  • Reversal in Second Circuit of $18 million judgment against Internet billing service in action for deceptive and unfair trade practices brought by the FTC.
  • Defense of hedge fund, its principal and manager in multiple investor suits in state and federal courts in New York alleging fraud, breach of fiduciary duty and breach of contract.
  • $5.5 million judgment (including $500,000 in punitive damages) after bench trial in New York Supreme Court in partnership dispute over proceeds of wireless license sale; in related proceeding, won $300,000 contempt award (plus attorneys fees) after separate trial on contempt.
