Elliott Z. Stein is Counsel to Lowenstein Sandler’s Litigation Department and a member of its White Collar Defense practice group. He focuses his practice on capital markets/structured finance litigation, white collar criminal defense, SEC enforcement proceedings, internal investigations and complex commercial litigation. He represents both individuals and entities in state and federal court litigations, and in investigations conducted by the SEC, FINRA, and the U.S. Attorney’s Office. He has handled cases concerning allegations of securities fraud, wire fraud, bank fraud, money laundering, options backdating, insider trading, broker-dealer sales practices, stock manipulation, the Foreign Corrupt Practices Act, antitrust violations, sale of unregistered securities, and Ponzi schemes.

Representative Matters
  • Defends the former CEO of a fund administrator in connection with litigation in the U.S. and Cayman Islands arising out of the Refco collapse;
  • Represents finance company in investigation and litigation of claims related to subprime RMBS and CDO transactions;
  • Represents broker-dealer in connection with SEC and FINRA investigations;
  • Represents television reporter in defense against shareholder derivative action alleging diversion of corporate assets;
  • Represents women's fashion company in litigating commercial dispute;
  • Defended a former officer of Hollinger International, Inc. in connection with criminal fraud charges, in an SEC investigation, in a securities class action, and in an action by a former employer concerning allegations of breach of fiduciary duty and diversion of corporate assets;
  • Represented a multi-national telecommunications company in internal investigations concerning options backdating and potential FCPA violations;
  • Represented investor group in SEC investigation of bank conversion fraud;
  • Represented corporate client against claims brought by 9/11 clean-up workers;
  • Represented alleged arms-dealer against charges of terrorism.
