David M. Wissert is Deputy General Counsel to the firm and Chair of the firm's Employment Litigation Group. His practice encompasses a wide array of litigation (including first chairing trials) and counseling under federal and state laws governing the workplace. Mr. Wissert primarily represents management in discrimination actions, contract actions, disputes over non-competition and confidentiality agreements, and other employment torts. He counsels clients daily on their obligations under the Family and Medical Leave Act, Americans with Disabilities Act, Age Discrimination in Employment Act, Title VII and other federal statutes, including their state law counterparts, and assists clients with virtually all types of decisions affecting the workplace. Mr. Wissert has also been listed in Chambers USA: America's Leading Lawyers for Business since 2008, which praises him as "highly effective at turning tough cases around," and notes his "great ability to connect with juries." Following graduation from law school, Mr. Wissert clerked for New Jersey Superior Court Assignment and Chancery Judge Wilfred P. Diana.
Mr. Wissert represented the New Jersey Defense Association as amicus in the case of Maw v. Advanced Clinical, in which the New Jersey Supreme Court agreed that terminating an employee who refuses to sign a noncompete agreement does not constitute a violation of the New Jersey Conscientious Employee Protection Act, reversing the New Jersey Appellate Division's decision.
