Lowenstein Sandler's Appellate practice has an outstanding record of appellate victories in civil and white-collar criminal matters. Our lawyers have successfully defended clients on appeals that seek to overturn favorable lower-court rulings, and have obtained significant reversals of prior adverse rulings, representing clients who have turned to us at the appellate stage after having been represented by other counsel in the courts below. Our clients include public and private corporations, law firms, and individuals.
Although we have prosecuted and defended appeals in various jurisdictions across the nation, our home base is the federal and state courts in New Jersey and New York -- including the New Jersey Supreme Court, the New Jersey Appellate Division, as well as the Second and Third Circuit Courts of Appeal. We also have extensive appellate experience representing attorneys in disciplinary proceedings before the Office of Attorney Ethics, the Disciplinary Review Board, and the New Jersey Supreme Court. Because we appear regularly before the Justices and Judges on those Courts, we have an in-depth understanding of the developing case law and legal trends in these jurisdictions, and we know the most effective way to present arguments on behalf of our clients.
In addition, we strive in every way to be effective appellate advocates and are known for the thoughtfulness and thoroughness of our work. As a result, we are well-regarded by the judiciary, and have earned a reputation as being highly credible. When we advance a legal argument based on existing law, the courts can be certain that the argument is supported by both the law and the facts of the case. In addition, in those instances where we present novel arguments or advocate for an extension of existing law, the courts can be confident that there is a strong basis for the adoption of new law or the extension of existing law.
Ultimately, we understand that winning an appeal requires far more than making a good argument or filing a fine brief. Our success is grounded on our ability to assess and select the strongest appellate arguments; to gauge and employ the most effective means by which to present those arguments; to understand the jurisprudence and proclivities of the relevant court; to craft credible and convincing briefs; and to present the strongest and best oral arguments, while being fully prepared to answer completely the hard questions that the court may ask.
Our Appellate practice includes 16 lawyers with decades of federal and state appellate experience among them, including a former First Assistant Attorney General of the State of New Jersey; a former Chief Counsel to the Governor of the State of New Jersey; a former Assistant United States Attorney in the District of New Jersey; a former trial attorney with the U.S. Department of Justice, Civil Division; and various former law clerks for appellate and trial judges in the federal and state courts.
Among notable accomplishments, our lawyers have secured appellate decisions establishing new law and decertifying several class actions in a broad range of areas, including securities and derivative litigation, complex tort, environmental, consumer fraud, pharmaceutical products liability, antitrust, and civil Racketeer Influenced and Corrupt Organizations Act (RICO) actions.
